Customer account terms and privacy

This page is for people who order from shops that use Ember POS and make an Ember account to do it. One Ember account works at every shop that uses Ember. It is operated by Ember POS ("we", "us"). Shops that use Ember have their own Terms and Privacy Policy; this page covers your account.

1. What your account is

You sign in with your email and a 6-digit code we email you. There is no password. Your account keeps your name, mobile number, birthday (only if you give it), your delivery addresses, the orders you place while signed in, and, for each shop you use, your loyalty card, stamps, any tab or credit you have there, the gift cards you save, your favourite items, and whether that shop may send you offers.

2. Who sees what

• Each shop you order from gets what any order gives it: your name, your mobile number, what you ordered, and the delivery address for a delivery. It becomes part of that shop's own records, and that shop is responsible for them as the personal information controller.
• A shop never sees your email, your other shops, your other addresses, or your orders at other shops.
• We keep your account so it works everywhere. We are the personal information controller for your account. We do not sell your information and do not use it for advertising.
• On a delivery, when the shop sends its rider a link, your order page shows the rider’s name and where they are until they deliver. The rider sees what a delivery slip shows: your name, number, address and what to collect.
• The shop finder (emberpos.net/shops) uses your location only if you tap Near me, only to sort the shops, and does not save it.

3. Offers and news

A shop may send you offers only if you said yes for that shop, and you can say no again at any time on your account page. We email you about Ember itself only if you ticked that box. Sign-in codes and messages about your account are always sent.

4. Your rights

Under the Data Privacy Act of 2012 (RA 10173) you may see, correct, download or delete your information. On your account page you can change your details, download everything we hold in one file, sign out of any device, and delete your account.

Deleting your account removes your email, addresses, sign-ins, saved cards and favourites, and stops every shop sending you offers. Each shop keeps its own records of what it sold you (its receipts and books), as the law asks of it; to ask a shop about those, contact the shop.

5. How long we keep it

Your account stays until you delete it. Sign-in codes are kept for 3 days and work for 10 minutes. A signed-in device stays signed in for up to 180 days unless you sign it out.

6. Keeping it safe

Codes and sign-ins are stored only as scrambled fingerprints, never as they are. Wrong codes are limited, and every sign-in shows on your account page. If something there was not you, sign out everywhere and tell us.

7. Fair use

Use your own email and your own details. Do not use an account to place fake orders or to get into someone else's loyalty card or gift cards. We may close an account that is used to cheat a shop.
